Where Consent Is Collected
Verbal SMS consent is collected during an in-person repair intake or checkout interaction at Anaheim Cell Phone Repair.
Before sending an automated text message, an employee asks the customer whether Anaheim Cell Phone Repair may send service-related text messages to the mobile phone number provided by the customer.
Providing a telephone number for a repair ticket, receipt, appointment, or transaction does not by itself constitute consent to receive SMS messages.
Employee Verbal Consent Script
The employee reads or clearly communicates the following disclosure before requesting consent:
«Anaheim Cell Phone Repair would like to send service-related text messages to this phone number regarding your repair ticket, receipt, appointment, estimate, authorization requests, repair-status updates, parts availability, pickup notifications, warranty matters, transactions, and customer support.
Message frequency varies. Message and data rates may apply. You may reply STOP at any time to unsubscribe or HELP for assistance. Agreeing to receive text messages is optional and is not required to receive repair services.
Do you agree to receive these text messages from Anaheim Cell Phone Repair?»
Affirmative Consent Requirement
The customer must clearly answer “yes” before the employee records SMS consent or sends an automated service-related text message.
Silence, failure to object, or providing a mobile telephone number does not qualify as consent.
Employees may not assume consent or record consent on the customer’s behalf without receiving a clear affirmative response.
Customers Who Decline
Customers who decline SMS consent may still:
- Submit a device for repair;
- Request an estimate;
- Schedule an appointment;
- Purchase products or repair services;
- Receive customer support;
- Receive a printed receipt; or
- Receive a receipt by email.
SMS consent is optional and is not a condition of purchasing products or receiving repair services.
How Consent Is Recorded
After the customer clearly agrees, the employee records the consent in the repair-ticket or point-of-sale system.
The consent record includes:
- Customer’s mobile telephone number;
- Date and time consent was received;
- Repair-ticket or transaction number;
- Employee who obtained consent;
- Consent method: “Verbal – In Store”;
- Customer response: “Yes”; and
- Version or date of the disclosure presented.
